What are the difference between FELA and worker’s compensation?

There are many differences between FELA and worker’s compensation.  The two most important differences between FELA and worker’s compensation are: (1) In an FELA case, you must prove that the railroad was negligent in causing your injury, while in an Illinois worker’s compensation case, fault is not an issue, and (2) there are significant differences in the scope of damages available to injured railroaders in an FELA case as compared to the worker’s compensation benefits provided to people who suffer on the job injuries in Illinois that are covered by worker’s compensation.
