The client was a passenger on an ATV driven by a
neighbor who was driving up and down a number of steep hills and berms
in the neighborhood. In going down a particularly steep berm, he
bottomed out the ATV, bringing it to an abrupt halt and causing the client
to suffer a fractured humerus that required surgery. Settlement
