We reached a settlement on behalf of the wife of
an active duty sailor who underwent laparoscopic surgery to remove her
gall bladder. The suit alleged that the surgeon failed to use proper
technique to identify the cystic duct, the only structure which was
supposed to clipped an divided during the surgery and instead cut the
common bile duct. This necessitated multiple hospital admissions and
surgeries. Case settled after the defense expert was confronted with the
text if his own book which detailed the technique that was supposed to be
employed to identify the cystic duct, and what he recommended in his
book was not what the surgeon did. (Federal Tort Claims Act)
