We secured an arbitration award in favor of our client. The client went to the defendants’ home to babysit their children and was bitten in the face by the defendants’ dog, sustaining multiple dog bite wounds. Defendants claimed that she was a statutory “owner” of the dog under the Animal Control Act by virtue of agreeing to allow the dog in the home while she babysat and was therefore not entitled to recover. The arbitration rejected this defense, as well as claims that she provoked the dog by trying to pet it while it was growling at her. (DuPage County).
