We were able to reach a settlement on behalf of a financial executive who was involved in a rear-end car accident at the intersection of Golf Road and Waukegan Road in Morton Grove. The client had a long history of lower back complaints and had in fact last seen a chiropractor less than a week before the car accident. Following the accident, the client received a series of injections to his lower back and ended up undergoing surgery. During the discovery process, we were able to draw clear distinctions in the pattern of his complaint before versus after the accident and employed the services of a medical expert to tie the different threads of treatment from three different doctors together to make a cogent, compelling presentation of the causation issue. Initially, we collected $100,000 from the carrier for the at-fault driver and the presented an underinsured motorist claim through the client’s own insurance policy. The underinsured motorist carrier initially denied liability, claiming that the accident did not result in the need for surgery. Our presentation on the causation issues changed their assessment of the case, resulting in a very favorable settlement for the client. (Cook County)
